Bike Rental Agreement & Liability Waiver

This Bike Rental Agreement and Liability Waiver (“Agreement”) forms part of the Terms & Conditions of Moravia Bike Tours s.r.o. and applies to all customers (“you”, “the rider”) who rent bicycles or cycling equipment from us (“we”, “our”, “Moravia Bike Tours”).
By renting a bicycle, you acknowledge and agree to all terms below.
1. Rental Equipment
The rental may include:
Bicycle (touring bike, gravel bike, hybrid, or e-bike)
Helmet
Locks
Repair kit, spare tube, pump
Panniers or bags (if included in the package)
Phone mount or GPS device (if applicable)
Bike and/or GPS Navigation Computer
All equipment remains the property of Moravia Bike Tours.
2. Rider Responsibilities
By accepting the equipment, you agree that you:
Will ride responsibly and in accordance with local laws
Will use the equipment only for its intended purpose
Will not allow any other person to ride the rented bike unless explicitly agreed
Will immediately report any mechanical issues, unusual noises, or safety concerns
Will follow all safety instructions provided by Moravia Bike Tours
Understand that cycling involves inherent risks and requires personal judgment
3. Condition of Equipment
All equipment is inspected, maintained, and serviced before rental.
You acknowledge that:
You have checked the bicycle at the start of the rental
It is in good working order
Any existing minor marks or wear have been noted or shown to you
After acceptance, you are responsible for the bike and equipment until it is returned.
4. Damage, Loss & Theft
You agree to take reasonable care of the equipment at all times.
You are financially responsible for:
Damage caused by crashes, misuse, or improper handling
Replacement of stolen or lost equipment
Repair of frames, components, wheels, or electronics beyond normal wear
Replacement of a lost or stolen bicycle at fair market value
Normal wear (e.g., tyre wear, brake pad wear) is not charged.
If a bike is stolen, you must:
Notify us immediately
File a police report
Provide documentation upon request
5. Helmet Use
Helmets are mandatory for minors
Strongly recommended for all adults
We may refuse rental if you decline a helmet and conditions make riding unsafe
6. Mechanical Support
We provide:
A basic repair kit
Instructions for minor roadside fixes
Contact support for route or bike-related issues
You must be able to perform simple tasks such as fixing a puncture or adjusting the saddle. In remote areas, delays in support may occur.
7. Alcohol, Drugs & Impairment
This clause is essential and strictly enforced.
Moravia Bike Tours does not encourage or promote alcohol consumption before or during cycling
You are fully responsible for ensuring you are sober and fit to ride
Riding under the influence of alcohol or drugs is unsafe and may be illegal
Any accident, damage, injury, or third-party claim resulting from impairment is entirely your responsibility
We may refuse to provide equipment, or stop a rental, if you appear impaired — without refund
8. Road Conduct & Local Laws
You agree to:
Follow road rules in CZ, AT, and SK
Yield where required
Use lights when needed
Ride predictably and safely
Respect shared paths, pedestrians, and other cyclists
Fines, penalties, or legal consequences are your responsibility.
9. Liability Waiver
To the fullest extent permitted by law:
You participate in cycling activities at your own risk
You acknowledge the dangers of cycling, including collisions, falls, road conditions, weather, wildlife, and third-party actions
Moravia Bike Tours is not liable for injuries, accidents, damage, or loss arising from:
rider error
alcohol or drug use
weather or road conditions
misuse of equipment
failure to follow instructions
independent navigation decisions
Our total liability is limited to the amount you paid for the rental equipment.
This waiver does not exclude liability where prohibited by Czech law.
10. Return of Equipment
You agree to:
Return the bike and equipment at the agreed location and time
Ensure the bike is clean and reasonably maintained
Pay for any late return fees, if applicable
Late returns may impact luggage transfer timing or operational logistics.
11. Early Termination
Moravia Bike Tours may terminate the rental immediately if:
You misuse the equipment
You are intoxicated
You behave in a way that endangers yourself or others
You violate local traffic laws
You breach this Agreement
No refunds are provided in these cases.
12. Personal Property
Moravia Bike Tours is not responsible for:
Loss or damage to personal belongings
Items left on the bike or in bags
Electronics (phones, GPS) damaged during riding
Theft of items not directly provided by us
13. Bike Security & Care
Bikes must be locked at all times when left unattended.
For short stops during the day (e.g. cafés, shops), the provided frame lock or cable lock may be used. Even for brief periods, bikes must always be secured.
Overnight, bikes must be secured using the provided U-lock and attached to a fixed and immovable object (e.g. a designated bike rack or solid metal structure). Bikes must not be left outside overnight unless stored in a secure, designated and locked area (such as hotel bike storage).
A secured object must be fixed to the ground or structure. Items that can be easily moved, lifted, or dismantled (e.g. wooden fences, lightweight poles) are not considered secure.
E-bike batteries must be removed from the bike and taken into the accommodation overnight. Chargers should also be stored inside. Batteries must not be left on the bike unless it is stored in a secure indoor location.
Helmets, GPS devices, panniers and other accessories must be secured or taken with you when leaving the bike unattended.
Extra care must be taken in busy public areas (e.g. city centres, train stations, tourist sites), where bikes should never be left unattended without being properly locked.
Any theft, attempted theft, or damage must be reported to Moravia Bike Tours immediately.
Failure to follow these security requirements may result in the rider being held financially responsible for the loss or theft of the bicycle and/or equipment.
14. Governing Law
This Agreement is governed by the laws of the Czech Republic. Any disputes shall be resolved by Czech courts.
15. Acceptance
By renting a bicycle or equipment from Moravia Bike Tours, you confirm that:
You have read, understood, and agree to this Bike Rental Agreement
You are participating voluntarily and accept all associated risks
You release Moravia Bike Tours from liability as described above

Email confirmation
