1. Introduction

These Terms & Conditions (“Terms”) govern all bookings, services, and activities provided by Moravia Bike Tours s.r.o. (“Moravia Bike Tours”, “we”, “our”, “us”). By booking a tour or using our services, you (“you”, “the customer”, “the participant”) agree to these Terms in full.

Moravia Bike Tours operates self-guided cycling tours, bike rental, luggage transfers, GPX navigation provisioning, and accommodation booking services, primarily in South Moravia and the surrounding regions of the Czech Republic, Austria, and Slovakia.

Moravia Bike Tours s.r.o. is a limited liability company registered in the Commercial Register under file number C 148695 and maintained by the Municipal Court in Brno.

3. Scope of Services

We provide the following services:

  • Self-guided cycling tours

  • GPX route files and digital navigation materials

  • Accommodation booking and coordination

  • Luggage transfer

  • Bike rental and supporting equipment

  • Pre-tour and on-tour customer support

We currently do not operate guided tours.

4. Booking & Contract Formation

A booking becomes confirmed and contractually binding when:

  1. You submit a booking or enquiry form

  2. Moravia Bike Tours confirms availability by email

  3. You pay the required deposit

From this moment, your contract with Moravia Bike Tours is in effect.

5. Prices & Payment Terms

5.1 Deposit

A non-refundable deposit of 100 EUROs per person is required to confirm any reservation.

5.2 Final Payment

The full payment is due 40 days before the tour start date. If payment is not received by this deadline, the booking will be cancelled and the deposit retained.

5.3 Payment Method

We currently accept bank transfer only. Any associated bank or transfer fees are your responsibility.

6. Cancellation by the Customer

If you cancel your booking, the following terms apply:

Time Before Tour Start - Cancellation Fee

  • More than 40 days 100 EUR (deposit)

  • 39–20 days 50% of total price

  • 19–10 days 75% of total price

  • 9–0 days 100% of total price

Cancellations must be submitted in writing to info@moraviabiketours.com.

7. Rescheduling by the Customer

Rescheduling requests may be accommodated at our discretion and subject to availability. If rescheduling is not possible, the original cancellation terms apply.

8. Cancellations by Moravia Bike Tours

Moravia Bike Tours reserves the right to cancel any tour, at any time, for any reason, if circumstances arise that make the operation of the tour unsafe, impractical, or impossible.

Such circumstances may include, but are not limited to:

  • extreme weather

  • natural disasters

  • border closures

  • accommodation cancellations

  • route closures or major detours

  • health emergencies

  • operational limitations

In the event of cancellation by us, our liability is strictly limited to:

  • a full refund of payments made directly to Moravia Bike Tours, or

  • the option to reschedule to another available date.

Moravia Bike Tours is not liable for:

  • flights or transportation not booked with us

  • connecting travel

  • pre- or post-tour accommodation

  • lost holiday time

  • any consequential, indirect, or incidental losses

Participants acknowledge that self-guided cycling involves inherent variability, and itineraries may require adjustment or cancellation due to factors beyond our control. Comprehensive travel insurance is mandatory and is your responsibility to acquire prior to starting your tour. Failure to provide valid insurance may result in refusal to participate without refund.

9. Customer Responsibilities

By booking a tour, you acknowledge and agree that you:

  • You accept full responsibility for your actions while participating in the tour, including any injury, loss, or damage caused to other participants, third parties, vehicles, animals, or property.

  • You agree to indemnify and hold harmless Moravia Bike Tours against any third-party claims, demands, damages, costs, or legal expenses arising from your actions or omissions during the tour, except to the extent caused by Moravia Bike Tours’ gross negligence or wilful misconduct.

  • You confirm that your travel insurance includes adequate third-party liability cover for cycling activities in the Czech Republic, Austria, and Slovakia.

  • Are physically fit and capable of participating

  • Will follow local traffic laws and cycling regulations

  • Will use provided equipment responsibly

  • Will exercise independent judgment when navigating self-guided routes

  • Will maintain appropriate travel and medical insurance

  • Will comply with safety instructions provided by Moravia Bike Tours

10. Alcohol, Sobriety & Safety

This clause is essential and strictly enforced.

  • Moravia Bike Tours does not promote or encourage alcohol consumption before or during cycling.

  • You are solely responsible for ensuring your sobriety at all times while riding or using any equipment provided by us.

  • Cycling under the influence may be unsafe or illegal under Czech, Austrian, and Slovak law.

  • Any accident, injury, damage, or third-party claim arising from alcohol use is entirely your responsibility.

  • We may refuse to provide equipment or participation to anyone who appears impaired, without refund.

11. Accommodation Bookings & Flexibility

Accommodation is arranged on your behalf based on availability at the time of booking.

  • Specific hotels, guesthouses, or room types cannot be guaranteed.

  • If planned accommodation becomes unavailable due to full occupancy, operational changes, seasonal closures, or other circumstances, Moravia Bike Tours will provide a comparable alternative.

  • Reasonable substitutions are part of normal tour operations and do not entitle customers to refunds or compensation.

  • Additional costs incurred by guests at accommodations is the responsibility of the guest to settle outstanding bills. This includes but not limited to minibar consumption or extra paid services charged to rooms.

Any disputes regarding behaviour, damages, or additional charges during your stay may be handled directly with the accommodation provider.

12. Bike Rental & Equipment Use

By renting a bicycle or related equipment from Moravia Bike Tours, you agree that:

  • You are responsible for the safe and appropriate use of the bicycle and any associated equipment at all times.

  • You will return all rented equipment in the same condition as received, allowing for reasonable wear and tear consistent with normal cycling use.

  • You accept full financial responsibility for loss, theft, or damage, including partial damage, to the bicycle or equipment while it is in your possession, up to the full replacement value as determined by Moravia Bike Tours.

  • You are responsible for any damage or injury caused to third parties, including other persons, vehicles, or property, arising from your use of the rented bicycle or equipment.

  • For electrically assisted bicycles (e-bikes), you agree to:

    • use the bicycle in accordance with provided instructions,

    • charge batteries only using supplied chargers and appropriate power sources,

    • avoid misuse, overcharging, exposure to water, or improper handling of electrical components.

  • Any damage to e-bike batteries, motors, displays, chargers, or electronic systems resulting from misuse, improper charging, impact, water ingress, or negligence is your responsibility and may be charged accordingly.

  • Wearing a helmet is mandatory for minors and strongly recommended for all participants.

  • Moravia Bike Tours reserves the right to withhold, refuse, or withdraw rented equipment if it is used in an unsafe, illegal, or irresponsible manner, without entitlement to refund.

A separate Bike Rental Agreement & Liability Waiver forms an integral part of this contract and must be accepted prior to equipment handover. Failure to accept this agreement may result in refusal of equipment without refund.

Guests are responsible for ensuring their travel insurance includes cover for rented bicycles, e-bikes, and third-party liability arising from cycling activities.

13. Luggage Transfer

Luggage transfer includes the transportation of personal luggage between designated accommodations as part of the tour itinerary. Luggage transfer is provided as a convenience service only and does not constitute insured carriage or safekeeping of personal property.

By using our luggage transfer service, you agree that:

  • All bags must be clearly labelled with the information provided by Moravia Bike Tours.

  • Guests are responsible for ensuring luggage is securely closed and suitable for transport.

  • Fragile items, valuables, electronics, medications, documents, and cash must not be included in transferred luggage and travel entirely at your own risk.

  • Moravia Bike Tours accepts no liability for loss, theft, or damage to luggage or its contents under any circumstances, except where such liability cannot be excluded under applicable law.

  • Liability for any loss or damage, where legally applicable, is strictly limited to a maximum of EUR 100 per bag, regardless of the contents or value.

  • Moravia Bike Tours is not liable for delays, misdelivery, or damage resulting from accommodation access times, third-party handling, road conditions, traffic, weather, or other factors beyond our reasonable control.

  • Guests are responsible for arranging appropriate travel insurance that includes cover for luggage loss, damage, or delay.

14. GPX Files & Navigation Materials

GPX files, route notes, and digital resources are provided for your personal use during the tour.

  • Routes may change due to local conditions

  • Sharing, distributing, or commercially using GPX files is prohibited without permission

15. Route Changes, Safety & Itinerary Adjustments

All routes are prepared with care, but conditions may require modification due to factors beyond our control, including:

  • weather changes

  • construction or roadworks

  • bike path or border closures

  • safety issues

  • seasonal access limitations

  • detours required by authorities

Moravia Bike Tours may adjust distances, routes, timings, or recommended paths to maintain safety. Such adjustments are considered normal operational changes and do not constitute grounds for refunds or compensation.

Self-guided cycling requires independent navigation and a flexible approach to changing conditions.

16. Travel Insurance

Comprehensive travel insurance is mandatory for all participants. It must cover, at a minimum:

  • medical expenses and emergency treatment

  • personal injury

  • theft or loss of property

  • trip cancellation or curtailment

  • cycling and outdoor activities

  • third-party liability for injury or damage caused to others

Moravia Bike Tours is not responsible for any costs, losses, or claims arising from insufficient or invalid insurance.

17. Liability

To the fullest extent permitted by law:

  • Participation in cycling activities is at your own risk

  • Moravia Bike Tours is not liable for injuries, accidents, or damage arising from cycling, weather, navigation decisions, alcohol use, or third-party actions

  • We are not liable for consequential or incidental damages

  • Our total liability is limited to the amount paid for the tour

  • Moravia Bike Tours accepts no liability for claims, losses, or damages arising from acts or omissions of participants that cause injury, loss, or damage to third parties, including pedestrians, motorists, property owners, or other road users.

Nothing in these Terms excludes liability where prohibited by Czech law.

Participants acknowledge that Moravia Bike Tours does not provide third-party liability insurance on behalf of participants.

18. Force Majeure

We are not liable for delays, changes, or cancellations caused by events beyond our control, including but not limited to:

  • extreme weather

  • natural disasters

  • border closures

  • pandemics or health emergencies

  • strikes or industrial action

  • transport disruption

  • acts of war or terrorism

19. Complaints

We aim to resolve concerns promptly. Please notify us as soon as possible so we can assist. Formal complaints must be emailed to info@moraviabiketours.com.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved exclusively by Czech courts.

21. Updates to These Terms

We may update these Terms to reflect changes in operations or legal requirements. The latest version will always be available on our website.
